Q: If you find that a family member is a drug addict and help him/her go to the hospital for rehab, will he/she still need to be judged by the law?

 

ANS:

Article 21 of the Narcotics Endangerment Prevention Act states that : “If a violator of article 10 seeks therapy at a medical institution designated by the Department of Health, Executive Yuan, R.O.C. before his/her crime has been discovered, the medical institution will not be obligated to send the patient to a court or procuratorial organ. For any defendant or juvenile found in violation of article 10 during therapy, the prosecutor should decide to non-prosecution or the Juvenile Court (District Prosecutors Office Juvenile Court) should decide to non-trial, but limited to only one time.” Therefore, if a person seeks rehab at a medical institution before being caught by the police, he/she will have one chance to not be brought to justice.
